The NBA legend Testifies He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his competitive side and novelty within the sport motivated his effort with 23XI Racing to confront Nascar over perceived violations of antitrust rules.
Team Investment and a Will to Win
The owner disclosed financial and corporate details of his racing venture, saying he put in $40 million of his personal wealth into the Cup Series operation launched with partner Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I had no fear. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”
Central Issue: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a franchise. This system mirrors other major leagues with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on charter membership renewals.
Jordan was on the witness stand for an hour and exited the courthouse to a media frenzy, with onlookers and reporters clamoring for a view or a picture of the sports legend.
Spearheading the Fight
23XI Racing is leading the full-court press along with another racing team for Nascar to change a business model Jordan contended is breaking the law to keep two hands on the wheel.
For Jordan and and a fellow team representative, who testified before Jordan, are events from last September. Gibbs described a frantic and emotional six hours where the racing circuit informed teams they had to sign a charter agreement extension. The document spanned over a hundred pages detailing team compensation and a guaranteed spot in every race.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports concluded their sole viable path was to refuse a signature that extensive document and litigate the matter. All other teams signed the agreement.
The team owners reached out to Nascar about possible changes or extension options. Nascar wasn’t talking, Jordan said.
The Ultimate Motivation: Winning
Ultimately, the pushback against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Winning.
“Hamlin persuaded me adding a third car improved our chances to win,” he testified, sharing that he bought a third charter last year for $28 million despite the uncertainty. “So I took the plunge.”
Heather Gibbs’ Testimony
Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She said the timing of the contract signing demand was problematic.
According to her, the team founder first tried to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.
“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If there are 30, I have 30.”
